The following Terms and Conditions of Sale applies to all items and
games sold by Birmingham Vending Company, and the Purchaser (Buyer) agrees to all terms below by
making any purchase from Birmingham Vending Company, Inc.
1. All Sales are Final
- All games, machines,
signs, parts and accessories sold by us are considered special
orders and as such, are non-cancelable and non-returnable (NCNR)
after 24 hours from date and time of order, and all sales are
considered final, or if we agree to an order cancellation or return
based on policies for such extraordinary returns. Please be sure to
ask any product or shipping questions you may have about your
order or products prior to making your purchase with us.
Prices published by us or quoted by
our representatives may be changed at any time without notice. Due
to fluctuating market conditions, written quotations expire
automatically 24 hours from the date issued and subject to change or
termination with verbal or written notice during that period. All
verbal quotations are good for 24 hours and all quotations and
prices are subject to adjustment on account of new specifications,
modifications, quantities, shipment methods or other terms and
conditions which are not part of the original price quotation.
3. Refunds -
Refund is only given at company discretion anytime before item has
been loaded on a truck in route to customer.
- If customer has chosen to cancel after ordering, customer agrees
to pay all freight charges and restocking fees. Restocking fees
range from 10%-25%
5. Custom Orders
- All custom/special orders are Final, this will be noted on your
invoice. If canceled these items may have additional fees depending
on manufactures policy.
6. Shipping -
Customer should fully inspect package before signing Bill of Lading.
Customer is responsible for all assembly and
set-up unless otherwise noted on customer invoice. This is a special
service and fees could apply.
If delivery/shipment is refused customer is
responsible for all freight charges and restocking fees and
subsequent attorney fees if applicable. Orders can not be canceled
or refused because of shipping delays that are due to acts of
Items that are damaged due to freight are
returnable at time of delivery only. Once the Bill Of Lading is
signed by customer that game is received in good condition a claim
can not be filed.
If an item is DOA and the freight company has
left the premises, the customer agrees to work with our technical
support staff to try to diagnosis the problem. Most problems can be
fixed with our assistance.
7. Game Adjustments
- Game adjustments may need to be made after delivery due to effects
of transportation, such as vibration, shifting, etc, customer is
responsible for these adjustments. Our technical support department
will assist you via phone or email.
- Any and all warranty could be null and void if the customer does
not contact us prior to attempting any repairs or adjustments, turns
on game in severe cold weather or has work preformed by anyone not
authorized by our technical support dept.
Agreement To Terms -
The purchaser (Buyer) confirms that they have
read, and agrees to, all terms, conditions and store policies listed
in this document.
The Purchaser (Buyer) agrees that
this agreement and all transactions hereunder, or any dispute or
controversy arising out of, relating to, or in connection with any
purchase, transaction, agreement, or its interpretation, with Birmingham Vending,
Inc. shall be governed by the laws of the State of Alabama, County
of Jefferson, and agrees that in the event of Federal or State court
litigation, all cases will be filed, conducted and heard within the
State of Alabama, County of Jefferson.
